I. Basic provisions

The controller of personal data pursuant to Art. 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the “GDPR”) is REMAQ, s.r.o., Registered office at the address: tř. Tomáše Bati 1729, Post Code: 765 02, Otrokovice, Czech Republic, Entered in the commercial register kept by the Regional Court in Brno, File No. C 45583, Company ID No: 26920051 (hereinafter “REMAQ” or the “Controller”).

REMAQ greatly emphasises the transparency of the processing and protection of your personal data, which are considered strictly confidential, and handles them in accordance with the GDPR and other valid legal regulations on the protection personal data protection.

REMAQ values your trust and therefore, in accordance with the principle of transparency, it informs you by means of this “Privacy policy” about the processing of your personal data, which is necessary for the purposes specified below.

These principles apply to the website www.remaq.cz (hereinafter referred to as the “website”) and are primarily intended for the contractors, visitors of website, applicants for job positions, questioners and another person whose personal data may be processed by REMAQ.

 

II. Purposes of personal data processing and their legal grounds

 

1. Implementation and performance of the contractual relationship

REMAQ produces high-quality plastic regranulates. By recycling plastics, they create reusable and valuable material, which they return to production and thus contributing to a significant reduction in environmental pollution. In the course of these activities, personal data are processed, in particular those of the partner (customer, supplier) as a natural person, as well as other persons, typically the contact persons of the partner as a legal entity.

The purpose of the processing of personal data is the establishment to implement and perform the contractual relationship, i.e. the delivery of the ordered product, the provision of transport, the exercise of the rights and obligations arising from the contractual relationship between the partner and REMAQ and other contractual obligations. The legal basis for the processing of personal data is Art. 6(1)(b) GDPR, i.e. processing is necessary for the performance of the contract and for the implementation of the measures taken prior to the conclusion of the contract. We process the contact data of the natural persons who represent the partner as a legal entity on the basis of Art. 6(1)(f) GDPR, as this is necessary for the performance of the contract with the partner and the processing is based on the mutual legitimate interest of the partner and REMAQ in the provision of the agreed services.

REMAQ collects the following data for the aforementioned purpose:

  • Identification data (name, surname, ID number, social security number or date of birth, possibly personal number);
  • Contact data (e-mail address, mailing address, telephone number, position);
  • Bank account number;
  • Operation records (contracts, minutes from meetings, instructions, etc.);
  • Data about the order, delivery and payment;
  • Necessary communication between the partner and REMAQ.

 

2. Fulfilment of legal obligations within the accounting and tax agenda

We process accounting documents, data about your payments and other information required by law for the fulfilment of our legal obligations, i.e. Art. 6(1)(c) GDPR.

 

3. Communication with the inquirers

If you contact REMAQ via e-mail, its mailing address or other means, the information about your contact will be processed only for the purpose of the established communication with you.

The legal basis for the processing of personal data is Art. 6(1)(f) GDPR, i.e. the case when the processing is necessary for the purposes of the legitimate interests pursued by the Controller (development of relations with visitors to our website, efficiency of communication, presentation of our company name and protection of our brand image).

REMAQ collects the following data for the aforementioned purpose:

  • Identification data (name, surname);
  • Contact data (e-mail address, mailing address, telephone number);
  • Necessary communication between you and REMAQ.

 

4. Employee recruitment

If you wish to become a member of the REMAQ team and send us your curriculum vitae using the reply form, we will process your personal data for the purposes of the recruitment procedure for the position you have chosen. The legal basis for processing your personal data is Art. 6(1)(b) GDPR, i.e. the processing is necessary for the performance of a contract and for the implementation of the measures adopted prior to the conclusion of the contract.

If you participate in the 1st round of the recruitment process, you may be asked to give your consent to the processing of your personal data for the purposes of verifying or obtaining references from previous employers, public sources and public registers of legal and natural persons, verifying the accuracy of the information provided by you, and preventing conflicts of interest with the activities of the ORLEN Unipetrol Group.​

 

5. Sending offers of similar job positions

If you have given your consent to REMAQ to process your personal data for the purpose of registering you as a candidate for anothersuitable job position within the ORLEN Unipetrol Group, your personal data will be used to send you offers of similar job positions. The legal basis for processing your personal data is Art. 6(1)(a) GDPR which is your voluntary consent, which may be withdrawn at any time.

 

6. Operation of a camera system with a permanent recording (REMAQ’s monitored areas)

Locations and property of REMAQ are monitored by camera system with recording for the purpose of protecting the rights and legally protected interests of REMAQ or other subjects (in particular the protection of property, health, life and safety of persons located in the monitored areas) on the basis of a legitimate reason for the legitimate interest of the Controller (pursuant to Art. 6(1)(f) GDPR). The monitored areas are marked with pictograms and additional information.

For this purpose, REMAQ collects:

  • Video recordings by a natural person;
  • Vehicle registration number.

 

7. Fulfilment of labour-law relationships

REMAQ employees are informed individually about the processing of their personal data.

 

III. Period of storing data processing

REMAQ processes your personal data for the time necessary to achieve the purposes for which it was collected or for the period stipulated by legal regulation. After the passing of the storage period, REMAQ liquidates the personal data.

The Controller (REMAQ) stores the personal data:

  • For as long as is necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller, and to enforce any claims arising from this contractual relationship (for a period of 10 years following the termination of the contractual relationship);
  • for a period of 6 months from the end of mutual interaction as regards the personal data processed for the purpose of answering your request;
  • for the period stipulated by the applicable laws, in cases where we are complying with our legal obligations; in the case of accounting management, this period may be up to 10 years;
  • until the data subject withdraws his or her consent to the processing of personal data processing based on the data subject’s consent, or until the expiry of the specified period;
  • for a period of 6 months after the end of the recruitment process for the job position;
  • for a maximum period of 21 calendar days (camera footage from REMAQ’s premises).

 

IV. Handover of personal data

At REMAQ, your personal data are stored under maximum security and are only made accessible to authorised employees, or individual processors and controllers of personal data, only to the extent necessary to fulfil the specific purposes of the processing. The security of your personal data with these recipients is guaranteed by their contractual obligations.

In connection with the transfer of your personal data, we will ensure that the highest standard of protection for this type of data is maintained (data subject rights and privacy).

Non‐exhaustive list of categories of recipients of personal data: 

  • State administrative bodies: e.g. tax office, social security administration;
  • Insurance companies;
  • ORLEN S.A. holding company which provides IT support to the system for processing personal data;
  • Service providers (service organisation, marketing, IT etc.);
  • External auditors.

 

Under certain circumstances, REMAQ is authorised to disclose some of your personal data to law enforcement agencies or other public authorities in accordance with applicable regulations.

REMAQ as a member of the ORLEN Group, consolidates IT systems and your personal data may be stored on servers in Poland.

REMAQ does not transfer personal data outside of the EU, the EEA or to international organisations.

 

V. Your rights

You have the following rights in relation to the processing of personal data:

 

1. Right of access to the personal data

 In connection with the processing of personal data, you have the right to obtain information and a copy of the personal data processed about you, at your request. In the case of a repeated request, REMAQ is authorised to charge a reasonable fee for the copy of the personal data provided. We will inform you of this procedure.

 

2. Right to rectification

 If you believe that the personal data we are processing about you, are inaccurate, outdated or otherwise incorrect, please contact us and we will rectify them. We will rectify the data without undue delay, subject technical feasibility.

 

3. Right to erasure

If your personal data are no longer needed to fulfil the stipulated purpose for which it was collected, or if you withdraw your consent to its processing, we will delete it upon your request. In some cases, however, your right may be limited. For example, personal data that we process on the basis of our legal obligations cannot be deleted before the expiry of the archiving retention periods. As for the personal data related to the provision of services, they cannot be erased before the expiry of the time limits for the possible application of claims related to them (compensation of damages, claims, etc.).
 

4. Right to restriction of processing

 You have the right to restrict processing if:

  • the personal data which we process are inaccurate;
  • the processing is unlawful;
  • the personal data are no longer required, but you need them to establish, exercise or defend legal claim;
  • you object to the processing.

Your personal data will only be held by us for the restricted period and will not be processed without your consent. This restriction on the processing will last for as long as one of the above situations. You will be informed of any termination of the restriction.
 

5. Right to object

You may object to the processing based on a legitimate interest and for direct marketing. The justification of the objection will be assessed and you will be notified of the decision via your chosen contact channel.

 

6. Right to data portability

If you wish REMAQ to hand over your personal data to a third party, you may exercise your right to personal data portability. If the rights and freedoms of third parties are affected by the exercise of this right, REMAQ will not be able to comply with your request.

 

7. Right to withdraw consent to personal data processing

If personal data are processed on the basis of your consent, you may withdraw this consent at any time. If you wish to do so, please send us your request using our contact details or the contact details of the Data Protection Office of ORLEN Unipetrol RPA. The contact details are set out listed below and at the beginning of this policy.

 

8. Right to be exempted from automated decision-making including profiling

We do not engage in automated decision-making including profiling, as part of our business.

 

9. Right to complain to the supervisory authority

If you feel that your personal data are not being handled pursuant to the law, you have the right to submit a justified complaint to the The Office for Personal Data Protection, with its registered office at Pplk. Sochora 27, 170 00 Prague 7, Czech Republic.

VI. Social networks

The REMAQ website does not use any social plugins. REMAQ uses social media profiles that may contain photos and videos of various events organised by the company.

VII. Final provisions

We will update this Privacy policy to reflect changes in our information practices. When we make changes, we will update the date of the changes (in the footer). We will keep you informed about significant changes (web notification).
